Customer Usage Terms of Service
These terms apply to all customers of 903 Internet, Inc.
And all customers of Distributors or Resellers
for 903 Internet, Inc. Services

Agreement- 903 Internet, Inc. (Hereinafter known as "903") is an interactive online service provider for access onto the Internet, web site hosting and dedicated server hosting. This agreement sets forth the Account Terms and Conditions which apply to the person, company or organization (Hereinafter known as "Subscriber"or "Customer") that registers for an account with 903 or registers for an account with a distributor or reseller of 903 Internet access and other services offered by 903. The subscriber is deemed to have agreed to comply with all terms by submitting their registration application online or through use of the services provided.

Responsibilities- It is the subscriber's responsibility to determine if the dialup access number(s) provided by 903 is acceptable for use by them.  903 provides limited telephone technical support for subscriber's connection to the Internet.  903 is not responsible for assisting subscriber with diagnosing or repairing software, hardware or computer operating system problems.   Subscribers are encouraged to use the expertise and resources of the vendors providing these components.  Subscriber is responsible for maintaining backup copies of personal web pages, email and any other data.  Periodically, 903 will transmit broadcast email messages updating subscribers on current developments, news and promotions offered by 903.

Billing Period- All services provided by 903 are to be prepaid and will be billed in advance for the forthcoming period (Monthly, Semi-Annual, or Annually).  Any applicable local, state and federal taxes will be billed in addition to the service charges. If the subscriber utilizes a service, through 903, with any additional hourly fees or single-use special fees, these fees will be charged at the time of the next months billing.  Payments not received within 10 days of notice will be subject to a 1.5% financing charge. 903 reserves the right to terminate or discontinue service at any time for non-prepayment.   Billing starts when an account is activated and is not prorated. Future billing is done on the first of each month thereafter per the term of the account (Monthly, annual) with 903. Cancellations received after the first of the month will be charged for the next billing period. Failure to use account(s) does not relieve subscriber of payment obligations.

Terms of Payment - A subscriber using a credit card agrees to allow 903 to bill his or her credit card on each successive billing date without obtaining subscriber's permission after the initial charge. A subscriber using a credit card shall notify 903 of any changes in credit card number or expiration date. If the card is not honored for any reason, 903 will attempt to notify the card holder by using the telephone information given at sign-up or by E-mail.  If alternative billing has not been established, the account will be suspended or terminated. Restoring the account will be subject to an automatic minimum setup fee of $10.00.

If payment is by check, subscriber will pay for service in advance of the next billing period for their account.  903 may, at its discretion, send an email reminder notice to subscriber before payment is due.

903 maintains the right to suspended or terminate service for any unpaid accounts. Termination of Service shall not relieve subscriber from the obligation to satisfy outstanding charges. In the event 903 utilizes an attorney to collect any unpaid amounts, subscriber shall be responsible for the payment of all of 903 charges, damages, attorneys' fees and costs in the collection of these sums.

Returned Checks and Dishonored Credit Cards - In the event that a check is returned to 903 or a credit card charge is declined a charge of $25.00 will be incurred per occurrence. In the event that a charge-back for services already rendered is issued on a credit card there will be a $25.00 charge-back penalty for each occurrence.

Refunds - will NOT be offered on monthly accounts.  The 30 day money back guarantee only applies is cases where we have had a reasonable opportunity to solve your problems.  1 or 2 calls on the date you sign-up is not considered reasonable. Reasonable is 3 or more attempts with our tech support team to fix your connection issue(s). Refunds may be offered on 6 month and yearly accounts, and will be prorated at the monthly rate.  There is also a $10.00 early cancellation fee for ALL early cancellations. 903 will not refund shipping & handling fees, technical fees or any one-time start-up fees.

Right to Cancel  - Cancellations by subscriber must be requested via an email addressed to billing@903internet.com, a fax, or in writing via return receipt requested mail. Subscriber must provide current username, password and forwarding email address to cancel account. This is for your protection as well as ours.  We may at our discretion, require additional information from Subscriber to verify the authority of the request to cancel.  903 reserves the right to cancel Service for any reason without prior notice.

Billing Disputes - All billing disputes with 903 must be received at our business office in writing or sent via an email addressed to bill billing@903internet.com. Subscriber's obligation to pay for service will continue until such notice is resolved. Termination of subscriber's service does not constitute relief from amounts incurred prior to termination.

Legality of Content - The subscriber agrees to use 903 for lawful purposes only. The subscriber will not post or transmit any material, through 903, which violates or infringes upon the rights of others. This includes, but is not limited to: Threatening, abusive, defamatory, vulgar or obscene language, any action which threatens public or private rights, any action which encourages a criminal offense, any action which gives rise to civil liability or violates any law. Attempts to gain unauthorized access to 903 servers, networks or outside computer systems is expressly prohibited. Subscribers agree to abide by any and all rules of the network they access through 903. The subscriber agrees to defend and hold harmless 903, its directors, officers, employees, agents, vendors or affiliates for all damages and claims that might arise from the subscribers use or misuse of the service which damages or otherwise harms either the subscriber, 903 or a third party.

Time Limits - 903 customers may not leave their PPP dial-up accounts connected for more than 24 hours at a time. Your PPP Personal dial-up account is intended for unlimited personal use: Meaning, (And our definition is final) that you may have your connection up as long as you are personally in front of your PC. Your PPP dial-up personal account is not a dedicated account. If you disregard this policy and leave your account up for more than 24 hours, your account will be terminated and any prepaid fees will not be refunded.

Content Screening - 903 cannot and does not control the content of information available over the Internet. For this reason, the subscriber certifies that he/she is at least 18 years of age or, if the subscriber is a minor the parent or guardian assumes all responsibility for supervising the on-line activities of the under aged subscriber. Any information garnered through 903 is done so at your own risk.

Unauthorized Connections and Access - The subscriber shall not allow or make unauthorized connections to 903. The subscriber account is to only be used to gain PPP dialup access to the Internet using nonproprietary browsers.  It does not include telnet access or a Unix shell account. Subscriber shall not give their password to anyone or allow anyone to use their account.   Attempts to gain unauthorized access to 903 servers, networks or outside computer systems is expressly prohibited.  The subscriber shall not allow or conduct unauthorized reselling of 903, or the solicitation of 903 customers to become subscribers or customers to other online or Internet service providers in competition with 903, nor shall the subscriber make any unauthorized copies or duplications of any 903 material, advertising, forms, brochures, pamphlets and the like which is the property of 903.  Any violations of this policy will constitute a breach of this agreement and result in immediate termination, a minimum $500.00 fee per attempt to gain an unauthorized connection or unauthorized access to be paid to 903 immediately.  Subscriber agrees that if the Unauthorized Connections Policy is violated that the subscriber's credit card account will be automatically charged a minimum $500.00 fee per attempt to gain an unauthorized connection or unauthorized access as payment of this fee.  Payment of this initial fee does not waive any other fees, fines of penalties that may be levied by 903 or any other state, federal or international organizations.  Any prepaid amounts will be forfeited by subscriber and not included as part of the initial fee.

SPAM Policy - The transmission of any type of material (Email, files, images, etc), whether graphical or textual in content, sent through email, news groups or any other service provided or accessed by 903 to other subscribers or non-subscribers without their express consent is prohibited under the terms of this agreement. Transmission of the above referenced material that does not use the 903 network but refers to a web site or page contained on the 903 servers is also prohibited under the terms of this agreement.  Transmissions of any materials described above containing fraudulent or forged information in the headers of any transmission is also prohibited under the terms of this agreement.  Any violations of our SPAM policy will result in immediate termination and a minimum $500.00 fee per complaint and/or individual piece of material, to be paid immediately to 903.  Subscriber agrees that if the SPAM Policy is violated that the subscriber's credit card account will be automatically charged the minimum $500.00 per complaint or individual piece of material as payment of this fee.  Payment of this fee does not waive any other fines of penalties that may be levied by 903 or any other state, federal or international organizations.  Any prepaid amounts will be forfeited by subscriber and not included as part of the initial fee.

Relationship - The relationship between the subscriber and 903 is that of subscriber and service provider only. In the event of a violation of any terms and/or conditions set forth in this agreement, 903 reserves the right to immediately terminate the services provided to the subscriber, access or charge any fees described in this agreement and retain any and all prepaid monies, with the subscriber being fully responsible for any and all fees, fines and attorney's fees incurred by 903 with regard to this agreement at all trial and appellate court levels.  903 reserves the right to change prices at any time without prior notice to it's customers or the public. Price changes will not be retroactive for existing customers, regardless of the length of their existing service subscription and will start on the first of the month of the next anniversary of the subscriber's account.

Court Venue - In the event of a dispute, 903 and the subscriber agree that the venue for such litigation shall be Dallas County, Texas or any other location deemed acceptable by 903 and that the terms and conditions of this agreement shall be interpreted under the laws of the State of Texas.

Warranty Disclaimer - THE FOREGOING WARRANTIES SET FORTH ARE EXCLUSIVE AND NO OTHER WARRANTY IS EXPRESSED OR IMPLIED.

903 exercises no control whatsoever over the content of the information passing through 903 system. Use of any information obtained via 903 is at subscriber's risk. Neither 903 nor any of its affiliates, its licensers, its contractors or their respective employees warrant that the Service will be uninterrupted or error free; nor does 903 make any warranty as to the results from use of the Service.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NONINFRINGEMENT, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. NO ADVICE OR INFORMATION GIVEN BY 903, ITS AFFILIATES, ITS LICENSERS, ITS CONTRACTORS OR THEIR RESPECTIVE EMPLOYEES SHALL CREATE A WARRANTY. NEITHER 903 NOR ITS AFFILIATES, ITS LICENSERS, ITS CONTRACTORS OR THEIR RESPECTIVE EMPLOYEES WARRANTS THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ANY INFORMATION, SOFTWARE OR OTHER MATERIAL ACCESSIBLE ON OR FROM THE SERVICE IS FREE OF VIRUSES, CANCELBOTS, WORMS, TROJAN HORSES OR OTHER HARMFUL COMPONENTS.

LIMITATION OF LIABILITY - UNDER NO CIRCUMSTANCES SHALL 903, ITS AFFILIATES, ITS LICENSERS, ITS CONTRACTORS OR THEIR RESPECTIVE EMPLOYEES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT RESULT IN ANY WAY FROM SUBSCRIBER'S USE OF OR INABILITY TO USE THE SERVICE OR TO ACCESS THE INTERNET OR ANY PART THEREOF, OR SUBSCRIBER'S RELIANCE ON OR USE OF INFORMATION, SERVICES OR MERCHANDISE PROVIDED ON OR THROUGH THE SERVICE, OR THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN OPERATION OR TRANSMISSION, ANY FAILURE OF PERFORMANCE, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, YEAR 2000 COMPLIANCE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO ALTERATION OF OR USE OF SUBSCRIBER'S ACCOUNT, WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE OR UNDER ANY OTHER CAUSE OF ACTION. IN THE EVENT 903 IS FOUND LIABLE UNDER ANY CIRCUMSTANCE UNDER THE TERMS OF THIS AGREEMENT, 903 LIABILITY SHALL BE LIMITED TO THE UNUSED BALANCE OF SUBSCRIBER'S SUBSCRIPTION PAYMENT PRO-RATED TO REFLECT THE CURRENT TERM.

If Subscriber is dissatisfied with the Service or with any terms, conditions, rules, policies, guidelines or practices of 903 in operating the Service, subscriber's sole and exclusive remedy is to discontinue using the Service.

Indemnification - Notwithstanding anything to the contrary herein contained, subscriber agrees to indemnify and hold 903, its affiliates, its licensers, its contractors or their respective employees harmless against any and all liability, loss, claim, judgment, damage and expense including without limitation attorney's fees and cost of litigation incurred or suffered by 903, its licensers, its affiliates, its contractors, or their respective employees as the result of any and all use of subscriber's account whether authorized or not authorized or as a result of the negligence, willful misconduct, or breach of any of the terms of this Agreement by subscriber, including but not limited to claims, liabilities, losses, damage, judgment and expense which arise out of alleged injury or death of any person or damage to property of every kind and description. Subscriber shall promptly notify 903 in writing of any claim of which it is obligated under this indemnity. Subscriber shall have the right to assume the defense of any such claim. Subscriber and 903 shall confer as to and agree on the legal counsel(s) to be selected in any such defense.

Non-transferable - The right to use the Service is not transferable. Accounts are for subscriber's use only. Subscriber shall be responsible for the confidentiality of subscriber's password. Loaning subscriber's account to others, connecting a system used by multiple persons, group use of subscriber log-ins, and consuming more than one modem line are explicitly prohibited. If subscriber has multiple accounts, then subscriber shall be limited to one log-in session per system account at any time. Violation of the terms in this section shall constitute theft of Service and may be prosecuted under civil and criminal law.

Modification of Terms - 903 reserves the right to change or modify the terms and/or conditions, rates and/or services at any time. Such changes, modifications or additions shall be effective immediately.  Any provisions hereof found to be unenforceable by a court of law shall be severable and the remainder of the agreement shall stay intact.
